Lawsuit statistics

About 6,176 website accessibility lawsuits projected in the U.S. for 2026, nearly 20% more than 2025. 68% of lawsuits through June 2026 were against companies under $50M in revenue. Florida: most active federal jurisdiction in the U.S. for these claims.

What these claims usually cite

Most demand letters point to the same handful of barriers. These are the ones we find most often on restaurant and small business sites.

  1. Photos with no text description. A screen reader says nothing, or reads a file name.
  2. Menus and documents posted only as PDFs, with no headings or reading order.
  3. Buttons and menus that do not work with a keyboard.
  4. No visible focus, so keyboard users cannot see where they are.
  5. Text that is too faint against its background.
  6. Slideshows that move on their own with no pause button.
  7. Online ordering, booking or forms with unlabeled fields.
  8. No accessibility statement or way to report a problem.

Real repairs. No widget.

Overlay widgets do not repair a website. In 2025 the FTC ordered overlay vendor accessiBe to pay $1 million over its compliance claims. We fix the site itself.

FTC final order announcement

  1. Baseline. We record the site as it is today: scans, screenshots and notes.
  2. Repair. We fix the barriers in your site's own code and content.
  3. Documents. Menus and PDFs become accessible web pages, with a clean PDF for print.
  4. Validate. An independent specialist re-tests with NVDA and VoiceOver. We fix what they find.
  5. Document. You get a before/after remediation record for your attorney or insurer, plus an accessibility statement.

Most small sites are completed within 7 business days of site access.

Frequently Asked Questions

Does the ADA apply to my website?

The Department of Justice has said since 2022 that the ADA applies to the websites of businesses open to the public. Title III (42 U.S.C. § 12182) requires full and equal enjoyment of goods and services, and restaurants, shops, hotels and offices are all covered. Courts and settlements most often measure websites against WCAG 2.1 Level AA. This is general information, not legal advice.

Can you guarantee I will not be sued?

No one can. What we do is remove the barriers claims are built on, validate the result with screen readers, and give you dated documentation of the work and of ongoing monitoring.

Will an accessibility widget or overlay solve this?

No. Overlays do not fix the underlying code, and sites using them are still named in lawsuits. We repair the site itself.

How long does it take?

Most small sites are completed within 7 business days of site access.

What does the free risk scan include?

An automated WCAG 2.1 AA scan of your key pages plus a short plain-language summary of what we found. It is not a full manual audit, and we say so in the report.

Do you work with sites built by another agency?

Yes. We need administrator access, and we work on WordPress, Wix, Squarespace, Shopify and custom sites. Third-party tools such as online ordering platforms are documented and raised with the vendor.
